Then it shall be, on the day he causes his sons to inherit that which he has, that he may not make the son of the beloved the firstborn before the son of the hated, the firstborn.

English: “He causes his sons to inherit” — this teaches that the Torah gave the father permission to cause to inherit anyone he wishes. From here Rabbi Yochanan ben Beroka said: one who says concerning a person who is fit to inherit him, “Let him inherit me entirely,” even though there are other heirs, his words stand.

On the daf / in context: A father may concentrate the entire estate on one rightful heir. He may not, however, disinherit a rightful heir by negative language or transfer the estate to someone who has no inheritance right at all.

Type of Learning

Derash granting the father limited power of assignment among rightful heirs.

What Is Learned

A father may assign his entire estate to any one of the people who are already fit to inherit him; he may not invent new heirs or simply cancel a rightful heir’s share by negation.
