Core Text

English: “You shall possess it and dwell in it” — The school of R’ Yishmael taught: “You shall possess it and dwell in it” — by what means did you take possession? By dwelling. From here [we learn] that land is acquired by chazakah (presumptive possession through use).

On the daf / in context: The juxtaposition of inheritance and dwelling teaches that the act of settling and using the land effects legal acquisition.

Type of Learning

Derash on the verse (Sifrei / school of R’ Yishmael) — source for acquisition of land by chazakah.

What Is Learned

Real estate is acquired by chazakah; the dwelling itself constitutes the act of taking possession.
