יָכוֹל בָּא הַכָּתוּב לְחַלֵּק בֵּין יוֹם לַלַּיְלָה, שֶׁאִם הֲרָגוֹ בַּיּוֹם חַיָּב וּבַלַּיְלָה פָּטוּר? תַּלְמוּד לוֹמַר וְלַנַּעֲרָה לֹא תַעֲשֶׂה דָבָר, מַה לְהַלָּן לֹא חִלֵּק הַכָּתוּב בֵּין יוֹם לַלַּיְלָה אַף כָּאן לֹא תַּחֲלֹק בֵּין יוֹם לַלַּיְלָה.
