When there is a dispute between men and they come to judgment, and they judge them, and they declare the righteous one righteous and the wicked one wicked,
Torah Temimah points to Makkot 2a–b related.
TT lemma: וְהִרְשִׁיעוּ אֶת הָרָשָׁע.
English: ‘And they declare the wicked one wicked’ – from here, to lashes.
Derash linking verdict to punishment (Bavli) — the same section that requires a true verdict introduces the lashes.
Once the court has properly declared the guilty party guilty, the Torah continues with the law of lashes that follows in the next verses.
