Core Text of Chazal

Core Text — Makkos 11b

English: Abaye said: We hold that if his verdict was completed and he died, they bring his bones there [to the city of refuge], for it is written “to return to dwell in the land until the death of the priest” — what dwelling is in the land? Say: burial.

Type of Learning

Even a posthumous “dwelling” (burial) in the city of refuge fulfills the exile when the verdict preceded death.

What Is Learned

If the unintentional killer dies after judgment but before reaching the city, his bones are interred there as the fulfillment of the exile requirement.
