Parashas Masei · Passuk 35:25 · TT note 6
Chabad.org — English translation + Rashi
Torah Temimah points to Makkos 11b (TT note on “אֲשֶׁר מָשַׁח אֹתוֹ”).
English: If the High Priest died before the [killer’s] verdict was completed, and they appointed another in his place, and afterward the verdict was completed — [the killer] returns at the death of the second [High Priest]; for Scripture says “and he shall dwell in it until the death of the priest who anointed him” — does he himself anoint him? Rather, [it means] the one who was anointed in his days.
Which High Priest’s death releases when the original died before verdict.
The relevant High Priest is the one in office at the time of the verdict; his death, not the predecessor’s, frees the exile.
