Source Citation

Torah Temimah points to Kiddushin 68a.

TT lemma: עם החמור.

Sefaria — Kiddushin 68a

Core Text of Chazal

Core Text
עם החמור. עם הדומה לחמור, מכאן לשפחה כנענית דלא תפסי בה קדושין.

English: “With the donkey.” With one who is like a donkey—from here [we learn] that kiddushin does not take effect with a Canaanite maidservant.

On the daf / in context: The legal incapacity of a Canaanite maidservant to enter Jewish betrothal is anchored in the same comparison.

Type of Learning

Derash on the verse (Bavli sugya) — not a formal named middah of the 13. The phrase supplies a source for the invalidity of kiddushin with a Canaanite slave-woman.

What Is Learned

Kiddushin does not take effect with a Canaanite maidservant; she is “like a donkey” according to the verse.
