And if the man does not desire to take his yevamah, then his yevamah shall go up to the gate to the elders and say: “My husband’s brother refuses to establish a name for his brother in Israel; he will not perform the duty of a husband’s brother for me.”

TT lemma: וְעָלְתָה יְבִמְתּוֹ.
וְעָלְתָה יְבִמְתּוֹ – מַה תַּלְמוּד לוֹמַר יְבִמְתּוֹ? לְפִי שֶׁנֶּאֱמַר וְהָיָה הַבְּכוֹר אֲשֶׁר תֵּלֵד, יָכוֹל שֶׁאֲנִי מוֹצִיא קְטַנָּה וּזְקֵנָה? תַּלְמוּד לוֹמַר יְבִמְתּוֹ – יְבִמְתּוֹ רִבָּה.
English: “Then his yevamah shall go up” — why does Scripture say “his yevamah”? Because it was said “the firstborn that she bears,” I might exclude a minor or an elderly woman; therefore it says “his yevamah” — including them.
