And it shall be, if the wicked one is to be flogged, the judge shall cause him to lie down and be beaten in his presence, according to his guilt, by number.
Torah Temimah points to Yerushalmi Terumot 7:1.
TT lemma: כְּדֵי רִשְׁעָתוֹ.
Sefaria — Yerushalmi Terumot 7:1
English: R’ Natan son of R’ Hoshaya said: Whoever pays money does not receive lashes, as it is stated ‘and he shall strike him before him according to his guilt’ – [lashes apply to] the one whose lashes discharge him from his guilt; this excludes the one to whom we say ‘stand up and pay.’
Derash on the phrase “according to his guilt” (Yerushalmi) — not a formal named middah of the 13; lashes discharge the entire liability.
When the offense still requires monetary restitution, lashes are not administered; the flogging is reserved for the case in which it alone completes the penalty.
