And if his father has no brothers, then you shall give his inheritance to his kinsman who is closest to him of his family, and he shall inherit it; and it shall be for the children of Yisrael a statute of judgment, as Hashem commanded Moshe.

English: A person cannot bequeath to one who is not fit to inherit him, nor uproot the inheritance from the heir, even though this is money — because it is said “and it shall be for the children of Yisrael a statute of judgment,” to say that this statute is not altered and a condition does not avail in it.

Type of Learning

Immutable statute of inheritance.

What Is Learned

Contractual conditions cannot override the Torah’s order of heirs.
